Terms of use and consumer information for JustBooth software and subscriptions.

1. Provider and scope

These terms govern use of the JustBooth website and the JustBooth Android application provided by Emanuele Viglianisi, Altenbauerstraße 12, 4060 Leonding, Austria.

The website is informational and promotional. It does not operate a checkout or accept payment. Subscriptions are purchased through Google Play and are subject to the purchase information and terms shown by Google Play at the time of purchase.

JustBooth has a Private Plan and a Business Plan. A Private Plan customer is a consumer using the app predominantly outside their trade, business, craft, or profession. A Business Plan customer uses the app for professional or commercial photo booth services.

2. Description and purpose

JustBooth turns a compatible Android phone or tablet into a photo booth. Depending on the device and configuration, it can use the built-in camera, a supported Olympus mirrorless camera over a local Wi-Fi connection, or another Android device as a remote camera.

The app can provide countdown and capture controls, instant on-screen results, local event sessions and galleries, photo saving, sharing through apps selected by the user, printing through printing apps, kiosk mode, and administrator protection.

JustBooth does not supply cameras, printers, lighting, Android devices, internet connections, or other equipment. Compatibility with a particular camera, printer, sharing app, network, device, or operating-system version is not guaranteed unless expressly stated for that configuration.

The app is not intended for emergency, safety-critical, medical, or other situations where malfunction, interruption, or loss of a photo could cause danger to life, physical integrity, or substantial property damage.

3. Plans and features

The Free Plan includes the core photo booth functions and applies a "Made with JustBooth" watermark to photos. Personal and Business subscriptions unlock additional functions as described below and in the app.

  • Personal: removes the watermark and provides appearance, kiosk title, action-button, countdown-message, and photo-save-location customization for private events.
  • Business: includes Personal features and adds custom logos, banners, and white-label branding for professional photo booth services.

Feature availability can depend on the current app version, Android permissions, connected equipment, third-party apps, and the selected plan. New features may be added through updates.

4. Account and technical requirements

JustBooth does not require a JustBooth account or sign-up. A Google account and a compatible Google Play installation are required for Google Play subscriptions. The app can otherwise be used offline at an event.

The user is responsible for compatible Android hardware, camera and printer configuration, required permissions, local network access, compatible printing or sharing apps, storage capacity, and any third-party costs. The user must test the complete setup before an event.

The app's kiosk mode and administrator lock are device features and may be affected by Android settings, device policies, biometric availability, or system updates.

5. Subscription contract and payment

The presentation of plans on this website, in the app, or in Google Play is not a binding offer unless expressly stated otherwise. The subscription contract is concluded through Google Play when the purchase is accepted and activated there.

Personal and Business subscriptions are available with monthly or yearly billing where offered by Google Play. The exact price, currency, taxes, billing interval, payment method, renewal date, seller information, and applicable regional conditions are displayed before confirmation.

Subscriptions renew automatically unless canceled through the Google Play account or by another method provided by Google Play. Cancellation normally takes effect at the end of the current paid billing period. Google Play's terms and refund process apply to the store transaction and do not limit mandatory consumer rights.

Google Play may provide purchase, subscription, refund, and account support. JustBooth does not receive or store payment card details.

6. License and plan use

Subject to payment and compliance with these terms, the user receives a limited, non-exclusive, non-transferable right to use the app during the active subscription period and within the selected plan.

The Private Plan is for private, non-commercial use. It must not be used to provide paid photo booth services, promote a commercial activity, or generate revenue. The Business Plan may be used for the customer's professional photo booth services and events.

Users must not, except where mandatory law or the applicable open-source license permits it, resell, rent, sublicense, distribute, or make proprietary app components available to third parties; circumvent security or plan restrictions; use automated systems to interfere with the app; upload malware; or use the app unlawfully or in a way that infringes third-party rights.

Open-source components remain subject to their applicable licenses. Those licenses are not replaced by these terms.

7. Photos, user content, and third-party rights

Photos, videos, logos, templates, text, and other material captured, selected, created, printed, shared, or stored through JustBooth remain under the user's control. JustBooth does not upload them to a JustBooth server.

The user is responsible for ensuring that capturing, storing, displaying, printing, sharing, and publishing photos is lawful. This includes obtaining any required permission from people depicted, event organizers, venue owners, and rights holders, and complying with privacy, image-rights, copyright, trademark, and data-protection rules.

Photos may include identifiable people. In a professional event, the Business Plan customer is responsible for determining the lawful purpose and legal basis for processing those photos, providing required notices, honoring deletion requests, and securing the devices and exported files.

Printing, sharing, gallery access, and other exports may be performed by third-party apps chosen by the user. Those services have their own terms and privacy policies.

8. Data protection

Personal-data processing by JustBooth and the website is described in the Privacy Policy. The app uses local camera communication, local photo storage, Google Play Billing, and Firebase Analytics as described there.

Where the user independently determines why and how photographs or other personal data are processed, the user is responsible for complying with applicable data-protection law. JustBooth is not a hosted photo gallery or a data-processing service for Business Plan customers.

9. Availability, updates, and changes

JustBooth may be temporarily unavailable or restricted because of maintenance, app updates, Android or device changes, camera or printer failures, internet or local-network problems, Google Play or Firebase outages, third-party app failures, security measures, or circumstances outside the Provider's reasonable control.

The Provider may improve, modify, replace, or discontinue functions for objectively justified security, legal, regulatory, technical, compatibility, or abuse-prevention reasons. For consumers, changes to digital services and ongoing subscriptions are made only to the extent permitted by mandatory law. Where required, consumers will receive clear information and any applicable right to terminate.

A subscription does not guarantee uninterrupted availability, compatibility with every future device or third-party service, or a particular commercial result. Mandatory statutory update, conformity, and consumer rights remain unaffected.

10. Price changes

Prices for future subscription periods may change through Google Play. No price change applies retroactively to a billing period already paid for. Google Play will provide any notice, consent option, or cancellation right required by applicable law before a changed price applies.

11. Suspension and termination

A subscription ends when it is canceled or otherwise ends under the Google Play terms. Access to paid features may end at the end of the paid period. If a payment is refunded, reversed, charged back, or identified as fraudulent, the related paid access may be suspended or removed to the extent permitted by law.

The Provider may restrict use where necessary to prevent fraud, an immediate security threat, unlawful use, serious infringement of third-party rights, or a material breach of these terms. Mandatory consumer rights and legally required notice or refund obligations remain unaffected.

12. Withdrawal from a consumer purchase

For a consumer purchase of a digital service or subscription concluded at a distance, Austrian law generally provides a 14-day withdrawal period beginning with the contract. Where performance begins immediately, the withdrawal right may be lost only if the statutory requirements are met, including the consumer's express request or consent, acknowledgment of the loss of the right where required, and the required contract confirmation on a durable medium.

For Google Play transactions, use the Google Play withdrawal form or the process stated in the Google Play terms. If a transaction identifies Emanuele Viglianisi as the seller, a clear withdrawal statement may also be sent to emavgl.app@gmail.com or to the postal address in Section 1.

If the statutory requirements for loss of the withdrawal right were not met, mandatory withdrawal rights remain unaffected.

13. Statutory warranty and complaints

Mandatory statutory warranty and conformity rights for paid digital services apply. If a paid plan does not conform to the contract, contact support with the subscription details and a description of the problem so that the legally required remedy can be assessed.

Complaints can be sent to emavgl.app@gmail.com. There is no voluntary agreement to participate in a particular alternative dispute-resolution body. The former EU online dispute-resolution platform is no longer in operation.

14. Liability

The Provider is liable in accordance with applicable law. Nothing in these terms excludes or limits liability for personal injury, intent, gross negligence, mandatory product liability, data-protection obligations, statutory warranty, or any other liability that cannot legally be excluded or limited.

To the extent permitted by law and subject to the preceding paragraph, the Provider is not liable for loss caused solely by unsupported or incorrectly configured hardware, third-party apps, network failures, failure to install updates, failure to maintain backups, unlawful user content, or circumstances outside the Provider's control.

For Business Plan customers and to the extent permitted by law, the Provider is not liable for lost profit, lost revenue, business interruption, event interruption, indirect or consequential loss, or claims by the Business Plan customer's customers, guests, employees, or contractors, unless the loss results from liability that cannot legally be limited.

15. No guarantee of event results

JustBooth is a software tool and does not guarantee a particular number or quality of photos, event revenue, guest satisfaction, printer output, camera result, or uninterrupted operation during an event. Users should test the setup and maintain a practical backup plan.

16. Governing law and jurisdiction

Austrian law applies to the extent permitted by law. If you are a consumer, this choice does not deprive you of mandatory protections of the country where you have your habitual residence. No exclusive jurisdiction clause is imposed on consumers; statutory consumer jurisdiction rules, including section 14 of the Austrian Consumer Protection Act, apply.

17. Changes to these terms

Changes apply to future website use and future subscription contracts from the date stated in the updated version. A change does not retroactively alter a completed billing period or remove mandatory consumer rights.

If a change materially affects an ongoing consumer subscription, the Provider will provide clear information and any notice, objection, or termination rights required by law. For Business Plan customers, continued use after a properly notified change constitutes acceptance only to the extent legally permitted.
